By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to STACKVES.

STACKVES is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

The Shipves app stores and processes personal data that you have provided to us, to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Shipves app won’t work properly or at all.

The app does use third-party services that declare their Terms and Conditions.

You should be aware that there are certain things that STACKVES will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but STACKVES cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that the terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, STACKVES cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, STACKVES cannot accept responsibility.

With respect to STACKVES’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. STACKVES accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

At some point, we may wish to update the app. The app is currently available on Android – the requirements for the system(and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. STACKVES does not promise that it will always update the app so that it is relevant to you and/or works with the Android version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

Content

Shipves allows you to post content, including photos, comments, links, and other materials. You are solely responsible for the User Content you post to Shipves .

If you choose to post content, you give us permission to use it to provide and improve Shipves . Copies of content shared with others may remain even after you delete the content from your account.

We also may notify law enforcement when we believe there is a genuine risk of physical harm, a direct threat to public safety, or a violation of the law.

Shipves may terminate or suspend your right to access or use Shipves for any reason on appropriate notice. We may terminate or suspend your access immediately and without notice, if we have a good reason, including any violation of our Content Guidelines.

No Guarantees

While we strive to provide a valuable and effective service, we do not guarantee any specific results from the use of the Service. The Service is provided on an “as is” and “as available” basis, and your use of the Service is at your sole risk. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement

Arbitration

For any dispute you have with Shipves, you agree to first contact us and try to resolve the dispute with us informally.

Privacy

  • Our Privacy Policy incorporated by reference in these Terms of Service sets out how we will use the personal information you provide to us. By using this Website, you agree to be bound by the Privacy Policy and warrant that all data provided by you is accurate and up to date.

The exactness of the Product

  • The images and details of the items on the App/Website are for illustrative purposes only. Although we have made every effort to display accurately, we cannot guarantee that your computer’s display accurately reflect the details and image of the items. Your items may vary slightly from those images. All sizes and measurements of items are approximate; however we do make every effort to ensure they are accurate as possible. We take all reasonable care to ensure that all details, descriptions and prices of items are as accurate as possible.

Pricing

  • We ensure that all details of prices appearing on the website/App are accurate, however errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible. If we are unable to contact you we will treat the order as cancelled. Additionally, prices for items may change from time to time without notice. However, these changes will not affect orders that have already been dispatched. Please note that the prices listed on the website are only applicable for items purchased on the website and not through any other source.                                                                                      

Payment

  • Upon receiving your order we carry out a standard pre-authorization check on your payment card to ensure there are sufficient funds to fulfill the transaction. Goods will not be dispatched until this pre-authorization check has been completed. Your card will be debited once the order has been accepted. Delivery

  • An estimated delivery time is displayed on the order summary page. On placing your order, Sometimes, delivery may take longer due to unforeseen circumstances. In such cases, we will proactively reach out to you by SMS & Calls. However, we will not be able to compensate for any mental agony caused due to delay in delivery.                                       

Returns, Refund & cancellation

Violation & Termination

  • You agree that the Company may, in its sole discretion and without prior notice, terminate your access to the website/App and block your future access if we determine that you have violated these Terms of Service or any other policies. If you or the Company terminates your use of any service, you shall still be liable to pay for any service that you have already ordered till the time of such termination.

  • IN NO EVENT WILL THE COMPANY OR IT’S REPRESENTATIVES BE LIABLE FOR ANY DAMAGES, ARISING OUT OF OR RELATED TO MISUSE OF PERSONAL INFORMATION OF THE CUSTOMER AND THE CUSTOMER IS SOLELY LIABLE FOR SUCH ACTS AND THEY ARE ADVISED NOT TO SHARE THEIR CONFIDENTIAL INFORMATION LIKE SHIPVES PASSWORD, OTP, CREDIT/DEBIT CARD EXPIRY AND CVV WITH ANYONE EVEN THOUGH THEY CLAIM TO BE A SHIPVES.COM EMPLOYEE. NONE OF OUR EMPLOYEE WILL ASK FOR SUCH CONFIDENTIAL INFORMATION.

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.
